A bench warrant has been issued against former State House Special Assistant for Policy Implementation and Monitoring Jack Kalala for missing court proceedings.
This is in a matter in which the court set ruling in a matter on a case to answer involving Munali constituency PF aspirant Mike Mposha over a bounced cheque issued by Mr Kalala.
Lusaka Magistrate Nchimunya Simaubi had earlier set 31st March 2016 as the date for delivery of the ruling but was forced to adjourn to yesterday due to the accused’s continued absence from the court.
The magistrate has since issued a bench warrant for the immediate arrest of Mr Kalala, 64, of house number 100/5 Ibex Hill, Lusaka.
“This being the second time the accused is absent without any excuse, the application is granted. Order of bench warrant to be issued accordingly and retainable on 18th April, 2016,” Magistrate Simaubi said.
Mr Kalala has been on police bond and was well aware of the dates for the court ruling but was absent together with his lawyers without any explanation of their non-attendance.
Thiså was in a matter concerning two counts of obtaining goods by false pretences contrary to the Penal Code as well as issuing a cheque on insufficiently funded account against the Payment and Financial Systems Act of 2007.
In the first count, Mr Kalala was accused of obtaining good by false pretences contrary to section 309 of the Penal Code Chapter 87 of the laws of Zambia.
Particulars of the offence were that Mr Kalala between February and May 2015 with intent to defraud or deceive did obtain explosives and explosive accessories altogether valued at K143,025-99 from Mr Mposha pretending he was going to pay for them when in fact not.
And in the second count, Mr Kalala is charged with issuing a cheque on an insufficiently funded account contrary to section 33(1) of Act No. 1 of 2007 of Payment and Financial Systems Act.
“On 11th March 2015, Mr Kalala willfully and dishonestly with intent to defraud or deceive, did issue a First National Bank cheque number 000082 in the sum of K40,000-00 to Mike Bilton Mposha on insufficient funded account,” the charge read.
Mr Kalala served under president Levy Mwanawasa.
