Court orders resignation of land evaluator

A CHARTERED Valuation Surveyor has asked the Lusaka High Court to order for the immediate resignation of the Director of Valuations, Brian Burton Stephen Chirwa for masquerading as a surveyor contrary to the Valuation and Surveyors Act.   This is contained in a statement of claim filed before the Lusaka High Court where former Munali Constituency Member of Parliament and Chartered Valuation Surveyor Sonny Mulenga has accused Mr Chirwa of pretending to be a surveyor when, in fact, he was not. Mr Mulenga submitted that the person in-charge of valuations in the Government was not a member of the Chartered Valuation and Surveyors and so stood ill-qualified for the job. He said under the Valuation Surveyors Rules, any person who has not paid the annual subscription to the board did not qualify to practice as such. “The Valuation profession is governed by Chapter 207 of the Laws of Zambia known as the Valuation Surveyors Act. “Under section 8 of the Valuation Surveyors Rules subsection (6), it is a requirement that every surveyor pays an annual subscription to the Board on or before the 1st of July in each year,” he said.He explained that Mr Chirwa has, however, been practicing as a surveyor and heading the Valuation Department under the Ministry of Local Government without paying his annual subscriptions for three years. Mr Mulenga said under the law, it was clear that a member ceased to practice and remained unregistered and so prohibited from practicing as a Valuer. He said the director has abrogated the rules and has acted with impunity and so must step down immediately. Mr Mulenga has since requested that the Court orders that Mr Chirwa immediately steps down as Director of Valuation in the 2nd defendant. “An order that the continued masquerading of the 1st defendant is contrary to public policy,” he stated.
