Kitwe High Court jails cell phone thieves 3yrs

THE Kitwe High Court has sentenced two men of Kitwe to three years imprisonment with hard labour for stealing a cell phone and a sum of K620 from Fortune Mbale.

Kitwe High Court Judge Mercy Makubalo sentenced Misebo Musongo 20 and Joshua Singogo 23 to three years imprisonment with hard labour after they pleaded guilty to the charge.

Facts of the offence are that on June 6, 2015, Musongo and Singongo stole a phone and a sum of K650 all of them amounting to K970 belonging to Mbale.

When the matter came up for plea the two pleaded guilty to the charge of theft from person after it was reduced from aggravated robbery charge.

The court heart that on the material night around 23:30 hours the complainant was coming from Cha-Cha-Cha township when the now convicts attacked him in Saint Anthony compound.

During the attack, the woman who was passing by called the name of one of the convicts who immediately bolted away with the items.

The following day, the complainant reported the matter to Kitwe Central police and later that same day the two men were apprehended and charged with aggravated robbery.

In mitigation the defence lawyer Mweendalubi Kapukutala pleaded with the court that the now convicts were young who could be better persons if pardoned and that the period they had spent in prison had taught them crime did not pay.
